KUALA LUMPUR (Nov 7): Attorney General Tan Sri Mohd Dusuki Mokhtar has sought an audience with the King, Sultan Ibrahim Sultan Iskandar, to seek forgiveness and affirm his commitment to complying with the royal decree on the conditional pardon order involving former prime minister Datuk Seri Najib Razak in the SRC International Sdn Bhd case.
The Prime Minister's Office (PMO) said in a statement on Saturday that the attorney general would also clarify legal issues arising from the High Court's discharge order following the payment of a RM50 million fine, which must be decided by the court as they affect the commencement date of the prison sentence in the 1Malaysia Development Bhd (1MDB) case.
The statement followed Prime Minister Datuk Seri Anwar Ibrahim's directive to Mohd Dusuki to seek an immediate audience with the King to clarify issues surrounding the implementation of Najib's conditional pardon order.
Anwar said the move is necessary to explain the legal constraints concerning the remainder of Najib’s prison sentence in the SRC case, as well as the implications for another case involving him, namely the 1MDB case.
Sultan Ibrahim on Saturday decreed that the implementation of the conditional pardon granted to Najib, which allows him to serve the remainder of his prison sentence under house arrest, must be respected in keeping with the principles of constitutional monarchy and the rule of law.
The King said the decision, granted under the royal prerogative of a pardon provided for in Article 42 of the Federal Constitution, must be implemented as decreed, without giving rise to prolonged confusion or uncertainty.
Sultan Ibrahim also decreed that the conditional pardon order is clear, explicit and unambiguous, and is not related to any other cases involving Najib.
“Since all conditions stipulated in the conditional pardon order have been fulfilled, any arguments disputing the order would amount to defying the decree of the Yang di-Pertuan Agong,” the statement issued by Istana Negara and shared on Sultan Ibrahim's Facebook page read.
On Friday, the Attorney General’s Chambers (AGC) said the implementation of Najib’s house arrest had been temporarily deferred pending further examination and clarification of the interpretation of the conditional pardon order and the implications of the order of discharge issued by the High Court here on the same day, following settlement of the RM50 million fine.
The AGC said during the deferment, Najib would remain at his current place of detention, subject to the powers and directives of the relevant authorities.
Najib was reported to have settled the RM50 million fine imposed on him in the SRC funds misappropriation case at the High Court Criminal Registry here on Friday.
