KUALA LUMPUR (Oct 20): Perikatan Nasional will challenge its deregistration and ask the court to stay the implementation of the Registrar of Societies action.
The opposition coalition also urged the attorney general to explain the government’s action in court, its secretary general Datuk Seri Takiyuddin Hassan said in a statement on Tuesday.
Takiyuddin said PN will file the court applications on Thursday.
“Perikatan Nasional urges the attorney general to explain this action regarding his department's stance in court during the hearing of PN's stay application on Oct 22,” he said.
Takiyuddin noted that “under Section 18 of the Societies Act 1966, any aggrieved society or office bearer can, within 30 days of the registrar's decision, appeal against that decision to the home minister”.
All members and supporters are urged to remain calm, abide by the law, and allow space for the court process, Takiyuddin, who is also Pas secretary general.
Earlier on Tuesday, the RoS deregistered PN over its inadequate response to a show-cause notice issued last month. It was also issued a notice to suspend its activities
PN has gone to the court to quash the notices. The High Court declined to pause the suspension of Perikatan Nasional and set Oct 22 to hear further arguments from both parties.
"The decision to act just days before the scheduled court hearing raises serious questions about the true motive behind the exercise of these powers and the government's respect for the judicial process," Takiyuddin said at a press conference later on Tuesday.
Perikatan Nasional’s deregistration centres on its failure to invite Bersatu to the coalition’s supreme council meeting on July 16, as well as for excluding the component party from deliberations.
However, Takiyuddin cited an internal precedent where member party Malaysian Indian People's Party (MIPP) was temporarily excluded from meetings during a leadership dispute in January without RoS involvement, stating that the same protocol was applied to Bersatu.
The deregistration means PN cannot use its logo for the Nov 14 Melaka polls but component parties may use their own emblems.
The component parties are weighing alternative strategies, including a common election logo, Takiyuddin said.
The High Court on Oct 13 allowed PN to challenge the suspension in court but declined the bloc's application for a stay.
Tensions between Pas and Bersatu over dominance of Perikatan Nasional have been simmering since earlier this year.
Pas cut political ties with Bersatu in June, but Bersatu still remain part of PN.
