KUALA LUMPUR (Sept 17): The judge presiding over the SRC International Sdn Bhd and 1Malaysia Development Bhd suits against Datuk Seri Najib Razak and the suit filed by Muhammed Yusoff Rawther against Prime Minister Datuk Seri Anwar Ibrahim will be transferred to Ipoh.

The Edge sighted a Malaysian Bar circular informing lawyers of High Court judge Datuk Raja Ahmad Mohzanuddin Raja Mohzan's effective date of transfer on Nov 1. The circular cited an order issued by Chief Judge of Malaya Datuk Seri Hashim Hamzah. 

It is understood that Raja Ahmad Mohzanuddin will continue to preside over the SRC International and 1MDB suits, but another judge will hear the case brought by Yusoff against Anwar.

Prior to this, Raja Ahmad Mohzanuddin had heard 1MDB’s suit against Datin Seri Rosmah Mansor’s son, Riza Aziz and Red Granite Pictures before it was withdrawn last year.

The judge is also presiding over all related SRC International civil suits against various individuals and entities, including politician Datuk Ibrahim Ali.

Raja Ahmad Mohzanuddin is also scheduled at the end of this month to deliver his decision on Anwar’s application to determine preliminary issues ahead of Yusoff's suit that alleges sexual assault by the prime minister.

Anwar is requesting that several issues regarding Yusoff's movements and presence at Anwar's private residence on the day of the alleged assault — Oct 2, 2018 — be decided either via affidavit or remote proceedings. Anwar argues that resolving these issues could potentially dispose of the entire case.

Yusoff, a former aid to Anwar, has opposed the application, arguing that he has waited since 2021, when the suit was filed, to have his day in court and that any arguments Anwar had could be raised during the trial.

The trial for Yusoff's civil suit has yet to commence.

Raja Ahmad Mohzanuddin is the third judge to hear the suit since it was filed five years ago.

Dr Mohammad Johan Lee was the first judge to hear the case, followed by Roz Mawar Rozain.

Prior to this, Johan had granted Anwar’s discovery application to Yusoff’s suit, before his transfer to Kedah. He has been posted back to Kuala Lumpur.

Roz Mawar had dismissed Anwar’s application to pose questions of law with regards to a suit against a sitting prime minister. Anwar had appealed against this decision before withdrawing it.

Roz Mawar had since transferred to the Seremban High Court.

It is not certain who will replace Raja Ahmad Mohzanuddin in Kuala Lumpur.
