KUALA LUMPUR (Sept 14): Datuk Seri Jamil Khir Baharom, a senior Umno leader, has been charged on Monday over alleged misappropriation of Lembaga Tabung Haji property worth nearly RM861 million.

Jamil Khir, a former minister in the Prime Minister’s Department in charge of Islamic affairs, arrived in court as early as 7.40am and proceedings began early at 8.45am before the normal 9am. He pleaded not guilty and claimed trial to the three charges before Sessions Court judge Rosli Ahmad.

The former Jerai member of Parliament was charged with dishonest misappropriation of Tabung Haji’s property worth nearly RM43 million to Al Rawda Investment for Real Estate Development and Projects Management Co Ltd at his ministerial Putrajaya office on April 3, 2015.

The second charge on Jamil Khir, who is also an Umno Supreme Council member, was over misappropriation of RM288.17 million of Tabung Haji funds similarly to Al Rawda at the same office on Dec 14, 2016.

He also faces a third charge involving RM529.19 million to the same Saudi company also at his office on Aug 17, 2017.

All the charges are framed under Section 403 of the Penal Code. If convicted, the 65-year-old could face a jail term of six months or not more than five years, and be liable for whipping and fine for each charge.

However, Jamil Khir may be spared of whipping due to his age.

Deputy public prosecutor Farah Ezlin Yusop Khan who appeared with Nurul Qistini Qamarul Abrar for the prosecution offered bail at RM1 million with one surety.

She said it is an appropriate sum as the alleged crime involved more than RM860 million. "This is a high profile case and the sum should be allowed with the accused passport to be impounded," Farah Ezlin said.

Jamil was represented by Datuk Hisyam Teh Poh Teik, Datuk Hamidi Md Noh and Datuk Ahmad Zaidi Zainal. Hisyam argued that bail should not be excessive as the purpose is to secure the attendance of the accused person.

"This is a bailable offence…out of respect he is prepared to offer his passport to court,” he said. "The defence offers a sum of RM300,000. He doesn’t have any source of income as he only receives pension as a former minister and a former army general."

Hisyam said Jamil's son is prepared to post bail and Rosli reminded the son of the duties in being a surety.

The bail was finally set at RM300,000 with one surety and his passport was surrendered to court. The judge also scheduled Nov 5 for mention.

Jamil had been remanded earlier this month to assist investigations in relation to Tabung Haji’s lease of two properties, one in Makkah and the other in Medina, following a royal commission of inquiry into Tabung Haji which allegedly discovered the losses.

Former Tabung Haji chairman Datuk Seri Abduk Azeez Abdul Rahim had last week been charged with one graft charge linked to construction company Putrajaya Perdana Bhd.

Abdul Azeez, who headed the pilgrims fund board from 2013 to 2018, is accused of misusing his position in August 2014 to land himself the role of chairman of Putrajaya Perdana, which came with an annual salary of RM690,000 and a BMW 7 Series car along with a driver.

Abdul Azeez was the chairman of Putrajaya Perdana for almost four years beginning January 2015.
