KUALA LUMPUR (Sept 9): The winding-up petition proceedings at the High Court here against Maju Holdings Sdn Bhd have been put on ice following a Shah Alam High Court granting a restraining order on Tuesday, effectively halting all legal proceedings against the company until early November.
Judicial Commissioner Ku Hayati Ku Haron, presiding in the Kuala Lumpur High Court on Wednesday, was informed of the restraining order.
The restraining order arose from an originating summons filed on Sept 2, 2026, by VLA Architects Sdn Bhd, which claims to be a creditor of Maju Holdings.
The draft order given by the Shah Alam Court allows VLA Architects to convene creditors’ meetings with Maju Holdings’ creditors, to consider a proposed scheme of arrangement, and an order restraining proceedings against Maju Holdings, including winding-up proceedings.
At Wednesday’s hearing, counsel for VLA Architects Kriishand G Krishnan confirmed in court that the application had been served on Maju Holdings last Friday (Sept 4).
Maju Holdings had informed the Kuala Lumpur court of the matter only late on Tuesday (Sept 8), after the close of business and on the eve of the scheduled hearing.
It should be noted that the draft order given by the Shah Alam court was obtained on Sept 8. The restraining order is effective until Nov 6, 2026.
Ku Hayati expressed to all parties her dissatisfaction with the late notification and regret over the resulting waste of judicial time and resources, and set Nov 11 as the next hearing date.
This latest moratorium is the third time the winding-up petition has been stalled by corporate rescue applications since its filing in 2023. The proceedings have been complicated by previous court orders, including a June ruling requiring prior permission for judicial management applications, and an August interim order restraining Maju Holdings from making applications capable of triggering automatic moratoria.
The winding-up petition was brought by a creditor of Maju Holdings, Bridgex Sdn Bhd, in 2023. The matter was fixed for hearing on Wednesday, but was hampered by the restraining order.
Bridgex is represented by David Matthews and Ivanpal Singh Grewal. They have several supporting creditors, including Zafas Sdn Bhd, Pembinaan Melima Sdn Bhd, and Antah Schindler Sdn Bhd.
