KUALA LUMPUR (Oct 13): Datuk Seri Anwar Ibrahim wants to strike out Hindraf chairman P Waytha Moorthy's legal bid challenging Anwar's election as the Tambun Member of Parliament and his subsequent appointment as the prime minister.
The application, filed on Oct 10 by Messrs Daniel & Wong, seeks to strike out Waytha Moorthy’s suit on the grounds that the suit, which concerns the 2022 elections, was filed out of time.
Besides this, they argue that any matters concerning elections has to be heard by way of an election petition before an elections judge.
In court documents seen by The Edge, Anwar also claimed that the originating summons was frivolous and was initiated for "collateral purposes", including political mileage.
In August, Waytha Moorthy had filed the suit seeking a court declaration that Anwar's 2018 royal pardon did not exempt him from the five-year constitutional disqualification imposed on individuals convicted of criminal offences.
In a statement responding to the suit, the Attorney General's Chamber said that there was no issue with Anwar's appointment, as the pardon by the 15th Yang di-Pertuan Agong was a full pardon where the PM is as a person who had never committed any offence.
Meanwhile, Waytha Moorthy had also filed an application on Oct 6 to refer two related questions of law for the apex court's determination.
Messrs Karthig Shan is acting for Waytha Moorthy in this matter.
Both Anwar and Wathya Moorthy's latest applications come up for case management on Oct 28.
