KUALA LUMPUR (Aug 28): Dr Shaariibuu Setev, the father of slain Mongolian Altantuya Shaariibuu, has filed a judicial review to compel the authorities to investigate or complete investigations into the contents of the Sept 24, 2024 affidavit of Altantuya’s murderer, former chief inspector Azilah Hadri.

The affidavit includes claims from his Oct 17, 2019 statutory declaration (SD) that he had acted under direct orders, which were not challenged by the prosecution in the highest court. 

The SD was part of an affidavit used to reduce his sentence from death to 40 years in jail and 12 strokes of the rotan on Oct 10 last year by the Federal Court.

In the judicial review filed by Messrs Karpal Singh, it was noted that former chief justice Tun Tengku Maimun Tuan Mat, in hearing the case at the Federal Court, had said the prosecution didn’t challenge Azilah’s affidavit or SD during the hearing.

The court also used the principle of proportionality when deciding his sentence.

The judicial review application filed on Monday, through Messrs Karpal Singh & Co, named the Inspector General of Police, the director of the Criminal Investigation Department in Bukit Aman, the police, Attorney General and the Malaysian government as respondents.

In his application, Shaariibuu asked the authorities to update him on the investigation and declared that not doing so was a breach of duty. 

He also wants the court to order the authorities to complete the probe into Azilah’s 2019 statement within a month and is seeking general, aggravated, exemplary, and punitive damages.

The matter has been fixed for case management on Sept 29 before judge Datuk Aliza Sulaiman.
