Arrest warrant issued for former Erdasan director Mak Siew Wei for missing court

SHAH ALAM (May 16): The Sessions Court issued an arrest warrant for former Erdasan Group Bhd (KL:ERDASAN) director Mak Siew Wei on Friday, after he missed court proceedings to face 14 charges of embezzling RM39.875 million from the company.

The proceedings continued in his absence.

Deputy public prosecutor (DPP) Law Chin How told the court that Mak was arrested by the Malaysian Anti-Corruption Commission (MACC) on March 5 and was released on bail the same day. However, he has been missing from his home in Rafflesia Damansara Perdana since then.

“The MACC had also sought help from the media within the same month to inform of Mak’s whereabouts, but to no avail. Our investigation officers went to his residence only to be told by his wife that he had yet to return since early March.

“Following that, on April 29, the MACC sought a magistrate order to prefer the charges and this is why we are here today. Following his absence, the prosecution asked for a warrant of arrest to be issued,” Law said.

He told the court that the MACC believes that Mak had run away to escape the charges in court.

Mak faces charges under Section 409 of the Penal Code, which could result in between two and 20 years in prison, a possible whipping, and a fine if convicted.

After a short break to review the documents, judge Datuk Mohd Nasir Nordin issued an arrest warrant for Mak. The arrest warrant was issued under Section 35 and 36 of the Criminal Procedure Code.

Mak was removed from Erdasan’s board on May 8 by shareholders’ vote, after being suspended since March.

He faces charges of criminal breach of trust involving RM39.88 million from the company’s subsidiaries between June 2020 and November 2021.

Erdasan suspended him on March 11, following an investigation into suspicious transactions, and the MACC is searching for him after the company’s officers reported his alleged misconduct.

“Company officers volunteered relevant information to the board of the company, following investigations done by the MACC,” Erdasan said in a bourse filing on March 24.

Erdasan has filed a RM46.47 million lawsuit against Mak at the Shah Alam High Court, accusing him of fraudulently diverting company funds. The company also seeks to have Mak declared as a trustee of the stolen funds, and wants his assets traced to recover the money.
