
KUALA LUMPUR (May 5): Sunview Group Bhd’s (KL:SUNVIEW) wholly owned subsidiary Fabulous Sunview Sdn Bhd (FSSB) is facing an adjudicated sum of RM1.67 million in relation to a dispute in a 50MWAC solar photovoltaic plant job in Pekan, Pahang.
Sunview told Bursa Malaysia on Monday that the adjudicator had determined and delivered his decision in favour of earthwork and infrastructure contractor TSS Cemerlang Sdn Bhd.
FSSB had been appointed as the sub-contractor for the provision of engineering, procurement, construction, installation, testing and commissioning (EPCC) of the plant for earthwork and civil works.
The adjudication decision, dated April 8, directed FSSB to pay the adjudicated sum on or before April 30 this year, with an interest of 5% per annum from the date of decision until full settlement.
FSSB was also ordered to bear all adjudication-related costs amounting to RM66,079.48, consisting of adjudicator fees, Asian International Arbitration Centre (AIAC) fees, AIAC appointment and registration fee, and party and party cost.
However, FSSB on April 25 filed an application with the High Court of Malaya in Kuala Lumpur to set aside the adjudication decision. FSSB also filed an application to withhold the execution or enforcement of the adjudication decision.
“The application to set aside the adjudication decision is premised, among others, on the grounds that in delivering the adjudication decision dated April 8, 2025, there was a denial of natural justice against FSSB and/or the adjudicator had exceeded his jurisdiction in making the said adjudication decision,” said Sunview.
The High Court will deliver its decision on Aug 7 this year.
Sunview’s share price was unchanged at 38.5 sen, bringing the group a market capitalisation of RM219 million. The stock has fallen 15% since the beginning of this year.
