KUALA LUMPUR (Oct 9): Muhammed Yusoff Rawther, who is already facing a drug trafficking charge, claimed trial to the possession of two fake pistols at the Magistrate Court here on Wednesday.
Muhammed Yusoff pleaded not guilty and told Magistrate S Mageswary that he “was framed by those in power”.
The former aide to Prime Minister Datuk Seri Anwar Ibrahim is charged with possessing the fake pistols at the side of the road near Sanada Kiara condominium, at Jalan Bukit Kiara 1 here at about 9:25am on Sept 6.
If found guilty under Section 36 (1) of the Arms Act 1960, he faces a maximum imprisonment term of a year or a maximum fine of up to RM5,000, or both.
He is represented by counsel Muhammad Rafique Rashid Ali.
Following this, Mageswary fixed Nov 12 for case management.
On Sept 12, he was charged at the Magistrate Court, with one count of trafficking 305 grammes of cannabis at the Kuala Lumpur Police Contingent headquarters’ surau on Sept 6.
As a result of this, Muhammed Yusoff has been in detention for the drug trafficking charge at the Sungai Buloh prison since Sept 6.
Muhammad Rafique’s law firm had also filed an originating summons for his client to be released on bail, citing the allegations of fabrication and danger of mental anguish.
This follows Muhammed Yusoff’s ongoing sexual assault suit against Anwar, which is scheduled for hearing next June. He accused Anwar of sexual misconduct in 2019, and mounted the civil suit in 2021.
Muhammed Yusoff had been Anwar’s aide in 2018, when Anwar was the opposition leader.
Besides challenging the constitutionality of Section 41B of the Dangerous Drugs Act, Muhammed Yusoff also wants Section 388 of the Criminal Procedure Code to be applied. In his affidavit in support of the application, Muhammed Yusoff said that Section 388 allows the court to be recognised on the principle of basic structure, as having the jurisdiction to grant bail.
