KUALA LUMPUR (June 28): The High Court here quashed a RM1.96 million fine imposed on CTB Solutions Sdn Bhd director Amirruddin Nin for failing to appear before the Securities Commission Malaysia (SC) for examination relating to a money laundering investigation.

In the appeal against his sentence, High Court judge Datuk Muhammad Jamil Hussin in his decision had quashed the decision by Sessions Court judge Kamarudin Kamsun last year with regards to the RM1.96 million fine. However, the High Court judge had upheld the one-day jail sentence and RM100,000 fine, which were also meted out by Kamarudin. 

Amirruddin was previously charged with three charges under Section 32(8)(a) of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 where the Sessions Court imposed (i) a one-day jail sentence for each charge, (ii) a RM100,000 fine for each charge, and (iii) a daily fine on continuous offence of RM2,000 amounting to approximately RM1.96 million.

On Wednesday (June 28), Jamil set aside the conviction and sentencing for the second and third charge against Amirruddin but retained only the first charge. This means that he will still have to serve his sentence for the first charge but not the second and third charge.

Lawyer Joshua Tay, representing Amirruddin, told The Edge Malaysia that he is waiting for instructions from his client on whether to appeal the jail sentence and the RM100,000 fine at the Court of Appeal.

CTB Solutions specialises in providing flexible integrated GPS fleet management solutions for various industries, where Amirruddin, 53, is a director.

In July last year when Amirruddin was charged, the SC had said that the offences were committed between June 15, 2017 and Feb 18, 2020.
